Abstract
En las últimas décadas, Chile ha sido un país que ha experimentado una serie de cambios sustanciales, en materia de leyes, las cuales se han sustentado en el tiempo, más aún, han logrado grandes modificaciones para perfeccionarlas con el propósito de su cabal cumplimiento. El crecimiento de la población ha demandado exigencias mayores a los gobernantes y al poder legislativo, estableciendo parámetros altamente exigentes en materias legales, específicamente para el logro de la inclusión laboral para personas con capacidades distintas. Las empresas han debido tomar conciencia que la inclusión llegó para quedarse, no tan solo por las leyes promulgadas, sino porque las empresas, tienen dos objetivos fundamentales, como son, tanto lo económico, como social, convirtiéndose éste último en el pilar fundamental de las leyes promulgadas, las cuales son, las leyes 21.015, promulgada el 29 de mayo de 2017, publicada el 15 de junio de ese mismo año, entrando en vigencia el 1 de abril de 2018 y la extensión de la misma se ha promulgado el 14 de agosto de 2024 y publicada en el Diario Oficial el 24 de agosto del mismo año, esta última busca reforzar y ampliar las oportunidades laborales para personas con discapacidad y asignatarias de pensión de invalidez, modificando normativas existentes y estableciendo nuevos mecanismos para la inclusión laboral. Por ésta situación, es importante hacer mención que, las empresas, las fundaciones, los entes fiscalizadores, en conjunto, deben cumplir los objetivos de las leyes(...).
In recent decades, Chile has experienced a series of substantial changes in its laws, which have been sustained over time. Indeed, significant modifications have been made to improve them for full compliance. Population growth has placed greater demands on governments and the legislature, establishing highly stringent legal standards, specifically for achieving labor inclusion for people with disabilities. Companies have had to realize that inclusion is here to stay, not only because of the laws enacted, but because companies have two fundamental objectives: economic and social. The latter is the cornerstone of the laws enacted. These are Law 21,015, enacted on May 29, 2017, published on June 15 of that same year, entering into force on April 1, 2018, and the extension of the same, enacted on August 14, 2024, and published in the Official Gazette on August 24 of the same year. The latter seeks to strengthen and expand employment opportunities for people with disabilities and disability pension recipients by modifying existing regulations and establishing new mechanisms for labor inclusion. Given this situation, it is important to note that companies, foundations, and regulatory bodies, as a whole, must comply with the objectives of the laws(...).
