Thesis MODELOS DE NEGOCIACIÓN: ANÁLISIS DEL PROCESO DE NEGOCIACIÓN COLECTIVA EN MINERA LA ESCONDIDA(2017) Altamirano González, Felipe Eduardo; Departamento de Ingeniería Comercial; Fernández Padrones, LuisThe aim of this document is to analyze the collective negotiation between Minera Escondida and the Union No.1 of operators, in relation to a proposed negotiation model and the benefits or prejudices of carrying it out following such negotiation model. Considering this, a general description of the traditional negotiation models is presented, to later select one of them and make a detailed comparative analysis of the different stages of the conflict, according to how they have been carried out and how they should be carried out according to the model.Another element subject to analysis corresponds to the effects generated by the strike of the MEL Trade Union No. 1 (Minera Escondida Limitada). While direct costs are evident, such as loss of productivity, substitution of workers, plant shutdown, etc., indirect costs such as the deterioration of the employer-worker relationship are often overlooked, even though it can have a much greater impact in the long term, affecting production and good working environment.Negotiation is present in our lives from our earliest age, and as we grow we are developing our own way of negotiating. We can ask ourselves "why should we negotiate?" And the answer naturally arises, "because we cannot always impose our will." However, what seems so logical is not always optimal in matters of worker-company relations.With data obtained from the press, the Chilean Copper Commission (COCHILCO - Comisión Chilena del Cobre), the Mining Council, the parties to the conflict (Petitions - collective agreement drafts) and the literature consulted it has been possible to dissect the MEL negotiation and propose a coorperative model for conflict solving as a successful alternative for both the company and its workers.
