Abstract
The execution of hospital infrastructure projects is characterized by a high level of technical and contractual complexity, which increases the likelihood of conflicts arising between the client and the contractor during their implementation. This thesis provides a technical analysis of a construction contract for a health center, which ended up in litigation due to various technical, contractual, and administrative issues that negatively impacted the project's original timelines and costs, affecting its economic viability. The analysis is based on a review of the case's contractual, technical, and legal background, including administrative documents, technical and expert reports, and the corresponding court ruling. Based on this review, the increased costs incurred by the contractor are examined from both a technical and economic perspective, evaluating the criteria used by the court to validate or reject the claims presented. These claims included the non-payment of additional overhead costs due to extended deadlines, financial costs, extraordinary works, and extra expenses during the provisional acceptance of the works. The results of the analysis clearly demonstrate that the main conflicts arose from ambiguities and deficiencies in the project's administrative framework, such as the definition of the scope of work and the compensation criteria for extensions to the deadlines. Furthermore(...).
