Abstract
Actualmente, las negociaciones colectivas en la Gran Minería se destacan por ser procesos cada vez más complejos; esto se explica, en parte, por la dificultad de las empresas de poder mantener la continuidad operacional de ciertos procesos mínimos necesarios para el negocio, lo que deriva a su vez de una falta de programación operacional respecto a las Negociaciones Colectivas internas y externas, aun cuando son conocidas sus complejidades y fechas de ocurrencia.
La complejidad de los procesos, sumado a la volatilidad e incertidumbre respecto al escenario social, político, económico y legal al momento de sentarse las partes a negociar, finalmente se convierten en dolores durante el proceso de Negociación Colectiva, generando una propensión de las compañías a llegar a acuerdos poco estratégicos.
El presente estudio tiene como finalidad poder abordar y mitigar ese problema de complejidad e incertidumbre a través de un análisis de la situación actual de la industria, diseñando una metodología de generación de planes de continuidad operacional y un modelo de plan de continuidad operacional, que permita asegurar mínimos de viabilidad de los procesos críticos, entregando así un aporte metodológico para la generación de planes en diferentes compañías e industrias, acompañado de indicadores para medir su impacto, y un plan de implementación.
Collective bargaining in the mining industry stands out for being increasingly complex processes; this is partially explained by the difficulty of companies in being able to maintain the operational continuity for certain minimum processes necessary for the business, generating a lack of operational programming regarding internal and external Collective Negotiations, even when their complexities and dates of occurrence are known in advance. The complexity of the processes, added to the volatility and uncertainty regarding the social, political, economic and legal scenario at the time the parties begin to negotiate, finally turn into pain during the Collective Bargaining process, generating a propensity for companies to reach non-strategic agreements. The purpose of this study is to be able to address and mitigate this problem of complexity and uncertainty through an analysis of the current situation of the industry, designing a methodology for generating operational continuity plans and their application through the development of a model of an operational continuity plan, which allows ensuring minimum viability of critical processes, thus providing a methodological contribution for the generation of plans in different companies and industries, accompanied by indicators to measure their impact, and an implementation plan.
