Abstract
El presente trabajo de memoria expone los problemas existentes por vicios ocultos del suelo en dos obras de construcción, la normalización del Hospital Regional de Copiapó y el proyecto inmobiliario Condominio El Remanso; donde la primera de éstas es una obra con financiamiento público, mientras la segunda corresponde a un contrato entre privados.
En el Hospital de Copiapó, el cual lo regía un contrato a suma alzada con reajuste de IPC contratado en pesos, se encontraron estructuras remanentes no informadas en periodo de licitación de grandes dimensiones, lo cual, en conjunto con otros factores de incumplimiento por parte del Mandante, provocaron un atraso de la obra de 317 días, y un aumento del costo de la construcción de $19.624.025.653.- netos.
Para el condominio El Remanso, regido por un contrato a suma alzada en UF, el Contratista encontró material rocoso que impedía la construcción de fundaciones, lo cual sí estuvo previsto por el Informe de Mecánica de Suelo del proyecto, pero no se da información de cantidad o lugar, con lo cual también, dentro de otros factores presentes por incumplimientos del Mandante, se generó el atraso en la obra de aproximadamente 526 días, con un aumento del costo por las obras de UF 65.979,31.
En esta memoria se detalla la cronología de los hechos y se presentan los antecedentes y efectos técnico-jurídicos derivados de los problemas encontrados por la presencia de elementos no declarados. En ambos proyectos, para la resolución del conflicto, se tuvo que llegar a instancias judiciales; en el caso del Hospital de Copiapó a una juicio civil con el Servicio de Salud de Atacama, y en El Remanso a una mediación por medio del CAM (Cámara de Arbitraje y Mediación de la Cámara de Comercio de Santiago); ambos hasta el día de hoy en curso.
The present work of title exposes the problems exist for hidden defects of the soil in two construction works, the standardization of the Regional Hospital of Copiapó and a real estate Project, the Condominium El Remanso; where the first one is a work with public financing, while the second is a contract between private. In the Copiapó Hospital, which was governed by a lump-sum contract with readjustment of IPC (consumer's price index) contracted in chilean pesos, remaining structures not reported in the large bidding period were found, which, together with other factors of noncompliance on the part of the Principal, caused a delay of the work of 317 days, and an increase in the cost of construction of $ 19.624.025.653.- net. For the El Remanso condominium, governed by a lump-sum contract in UF, the Contractor found rock material that prevented the construction of foundations, which was foreseen by the Project's Soil Mechanics Report, but no amount information is given or place, which also, within other factors present due to breaches of the Principal, generated the delay in the work of approximately 526 days, with an increase in the cost for the works of UF 65.979,31. This report details the chronology of the events and presents the technical and legal background and effects derived from the problems encountered by the presence of undeclared elements. In both projects, for the resolution of the conflict, it had to reach judicial instances; in the case of the Hospital of Copiapó a civil trial with the Health Service of Atacama, and in El Remanso a mediation through the CAM (Chamber of Arbitration and Mediation of the Chamber of Commerce of Santiago); both until today.
